1. What is a Colombian contractor?

A Colombian contractor is an individual that enters into a commercial contract with an entity for the provision of services, with administrative, legal and financial autonomy and without legal subordination.

2. How do you hire a Colombian contractor?

By means of a service contract for the provision of services.  The contract shall establish the object, purpose, term, the obligations of the contracting parties, the fees and its form of payment.  In this contract, the absence of legal subordination shall be made clear in order to avoid its re-characterization as a labour contract. 

3. How would FTC assist you to comply with local regulations and thus avoiding misclassification?

FTC shall assist you regarding the determination on whether the personnel to be engaged should be regarded as employee or contractor, based on the Colombian regulations.

For this, FTC shall ask you to provide certain information; and, based on that, FTC will provide you legal assistance regarding the proper classification.
